18-0079-09 ADOPT THE SOLID WASTE MANAGEMENT PLAN
A RESOLUTION TO ADOPT THE SOLID WASTE MANAGEMENT PLAN FOR THE STARK-TUSCARAWAS-WAYNE JOINT SOLID WASTE MANAGEMENT DISTRICT.
WHEREAS; IN CONSIDERATION OF THE ABOVE, NOW THEREFORE BE IT RESOLVED THAT THE CHIPPEWA TOWNSHIP IS LOCATED WITHIN THE JURISDICTION OF THE STARK-TUSCARAWAS-WAYNE JOINT SOLID WASTE MANAGEMENT DISTRICT (DISTRICT) THAT:
SECTION 1. THESE MEMBERS HEREBY ACKNOWLEDGE RECEIPT OF THE AMENDED DRAFT PLAN.
SECTION 2. THE CHIPPEWA TOWNSHIP APPROVES THE DISTRICT SOLID WASTE MANAGEMENT PLAN.
SECTION 3. THE CLERK IS HEREBY DIRECTED TO SEND THE DISTRICT A COPY OF THIS RESOLUTION TO THE ATTENTION OF MR. DAVID HELD, EXECUTIVE DIRECTOR, STARK-TUSCARAWAS-WAYNE JOINT SOLID WASTE MANAGEMENT DISTRICT, 9918 WILKSHIRE BLVD., BOLIVAR, OHIO 44612.
SECTION 4. THAT IS FOUND AND DETERMINED THAT ALL FORMAL ACTION OF THIS BOARD CONCERNING AND RELATING TO THE PASSAGE OF THIS RESOLUTION WERE ADOPTED IN AN OPEN MEETING OF THIS BOARD AND OF ANY OF ITS COMMITTEES THAT RESULTED IN SUCH FORMAL ACTIONS WERE IN MEETINGS OPEN TO THE PUBLIC IN COMPLIANCE WITH ALL LEGAL REQUIREMENTS INCLUDING SECTIONS 121.22 OF THE OHIO REVISED CODE.

Craig,

I am unaware of any state law that speaks to that situation regarding zoning. Generally, as you mention, agriculture is exempt from zoning under R.C. 519.01, 519.21. You may want to speak with your county prosecutor regarding your specific zoning code and how it might apply to an individual situation. Thanks!

Good Morning.

I thought I would ask you a question regarding maintenance on a property in our community.
The property in question is a 10 acre parcel that has a home, several outbuildings and a large pasture. The owner raises goats.
The situation is a bit tense with one of the neighbors. The property is very overgrown and the buildings are in poor repair. The goats escape the fencing regularly and love to go to the angry neighbors and eat all the delectable flowers and shrubs they use in the landscaping.
The question we ask is regarding a claim from the angry neighbor that Zoning ( which is in effect in our township) can force the Farmer to mow and maintain an acre and one half around the buildings.
We are not aware of any such regulation that zoning can use to force the farmer to clean up his property.
Are you aware of any such rule or regulation?
We have always understood that any agricultural use is exempt from zoning requirements.
If you could shed some light in this area for us, we would be grateful.
