DON NOBLE & BECKY JEWELL – RAILS TO TRAILS
THEY WERE BOTH PRESENT TO DISCUSS THE PURCHASE OF PROPERTY WITH GRANT MONEY. THIS SUBJECT WAS TABLED. THE TRUSTEES WANT TO TALK TO THE OWNER BEFORE SUPPORTING IT.

SANDY KIRKPATRICK – COMPLETE RESTORATION OF EXISTING BARN WITHOUT NEED FOR VARIANCE
SANDY WAS PRESENT AND I AM ASKING THAT WE PURCHASE A PERMIT TO RESTORE OUR BARN THAT WAS ALREADY EXISTING. WE WERE TOLD THAT WE NEED A VARIANCE AND IT WAS EXISTING BUILDING THERE, SO I DON’T UNDERSTAND THAT.
I AM ASKING THAT IN ORDER TO CLEAN OUR YARD EVERYTHING FROM THE OLD BARN (THE ROOF CAVED IN) WAS PUT OUTSIDE AND BEHIND THE BARN. WE WERE TRYING TO RESTORE THAT STRUCTURE THERE, SO WE CAN CLEAN OUR YARD BACKUP.
WE ALREADY HAVE A VARIANCE ON OUR OTHER BUILDING FROM YEARS AGO BUT WE ALREADY HAVE AN EXISTING BARN, SO I DON’T UNDERSTAND WHY ANOTHER VARIANCE WILL BE REQUIRED.
IT IS NOT IN THE PAPERWORK I READ IT BACK TO BACK.
DOMINIC OLIVERIO COMMENTED I AM GOING TO CALL ON OUR ZONING INSPECTOR CRAIG, KIND OF TO GET US UP TO SPEED ON THIS ISSUE.
CRAIG THORICHT STATED I DID NOT GET A COMPLAINT; I HAPPENED TO GO DRIVING BY, I SAW THE CONSTRUCTION. I DOUBLE CHECKED THERE WERE NO PERMITS TAKEN OUT. SECTION OF THE ZONING RESOLUTION IS ARTICLE 12; ADMINISTRATION AND ENFORCEMENT, SECTION 12.03 ZONING CERTIFICATES – NO PERSON SHALL CHANGE ANY USE OF LAND, A BUILDING, OR A STRUCTURE, NOR LOCATE, RELOCATE, ERECT, CONSTRUCT, RECONSTRUCT (IS THE KEY WORD HERE), ENLARGE OR STRUCTURALLY ALTER ANY BUILDING OR STRUCTURE IN CHIPPEWA TOWNSHIP WITHOUT FIRST OBTAINING A ZONING PERMIT.
I WENT TO THE PROPERTY TO INVESTIGATE THE KIRKPATRICK’S WEREN’T HOME. EVERY PIECE OF THAT BUILDING IS NEW. EVERY BIT IS NEW.
STEVE KIRKPATRICK STATED NO, IT IS NOT. THERE IS OLD WOOD IN THERE. WHEN I TOOK OFF THE OLD WOOD, I HAD TO ADD NEW BOARDS.
CHIPPEWA TOWNSHIP TRUSTEES REGULAR

TOWNSHIP HALL 7:00 PM MAY 8, 19

SANDY KIRKPATRICK – COMPLETE RESTORATION OF EXISTING BARN WITHOUT NEED FOR VARIANCE (CONTINUED)
CRAIG THORICHT STATED EVERY PIECE OF THE POSTS, ALL FRAMING MATERIAL IS ALL NEW.
STEVE KIRKPATRICK STATED NO YOU’RE MISTAKEN, IN THE OLD BUILDING THE OLD BOARDS ARE STILL THERE.
CRAIG THORICHT STATED THAT IS WHAT I AM USING FOR THE AUTHORITY HERE. NOW FURTHER INVESTIGATION, THERE ARE FOUR BUILDINGS. WELL THREE CURRENTLY. TOTAL OF EXCESSIVE SQUARE FOOTAGE ALLOWED FOR THE LOT THAT SIZE.
SANDY KIRKPATRICK STATED THAT IS WHAT WE HAVE A VARIANCE FOR THE BUILDING WE PAID FOR YEARS AGO.
CRAIG THORICHT STATED THEY DO HAVE AN OVERSIZED BUILDING AND THEY DID GET A VARIANCE FOR THAT AND IT FAIRLY GOOD SIZE. BUT STILL ANOTHER NEW BUILDING.
SANDY KIRKPATRICK STATED THERE WAS A BUILDING THERE.
CRAIG THORICHT STATED THIS IS KIND OF I HAVE TO DETERMINE IT IS NEW BUILDING AND THEY NEED TO GET PERMITS.
STEVE KIRKPATRICK STATED I DON’T HAVE A PROBLEM IN GETTING PERMITS BUT I DO HAVE A PROBLEM WITH GETTING A VARIANCE.
CRAIG THORICHT STATED THIS IS A NEW BUILDING AND THEY ALREADY STARTED AND I HAVE TO CHARGE THEM DOUBLED. THE FEES ARE SET BY THE TRUSTEES, THEY ARE NOT SET BY ME. I EXPLAINED TO THAT TO MR. AND MRS. KIRKPATRICK AND THEY DECIDED TO COME
LENNY BROOME ASKED IS THE SQUARE FOOTAGE OF THE OLD BARN IS THE SAME OF THE NEW BARN.
STEVE KIRKPATRICK STATED I MOVED IT OVER OFF THE PROPERTY LINE.
LENNY BROOME ASKED THE NEW BARN IS ACTUALLY LARGER.
STEVE KIRKPATRICK STATED BY A HAIR.
LENNY BROOME ASKED MR. THORICHT THEY SHOULD GET A VARIANCE BECAUSE IT IS A NEW STRUCTURE OR SHOULD BECAUSE OF THE SQUARE FOOTAGE. SOMETIMES I HEARD IF I HAD 10’X10’ SHED IN MY BACKYARD AND I REPLACE IT WITH 10’X10’ SHED. I CAN AWAY WITH THAT. IS THAT A TRUE STATEMENT?
CRAIG THORICHT STATED NO.
STEVE KIRKPATRICK STATED I WAS DOWN HERE AND CHECKED ON THAT BEFORE, I ASKED HIM IF I COULD PUT A LEAN-TO ON THE SIDE AND I DIDN’T WANT TO GO FOR A VARIANCE FOR THAT. SO, I THOUGHT I WILL FIXED WHAT I HAVE.
LENNY BROOME STATED WHAT YOU’RE SAYING THAT EVERYTHING UNDER THE SHEETING IS THE ALL OLD BARN.
STEVE KIRKPATRICK STATED I HAD TO PUT IN NEW POSTS AND SOME ACTUALLY FELL OVER.
LENNY BROOME STATED IS SOME OF THE ORIGINAL BARN IS EXISTING.
STEVE KIRKPATRICK STATED SOME IS THE EXISTING. I AM NOT PUTTING GOOD MONEY OVER BAD. I AM NOT PUTTING A NEW ROOF ON SOMETHING THAT IS NOT GOING TO LAST.
LENNY BROOME STATED I DON’T BLAME YOU.
WHAT DO YOU WANT TO DO BOARD.
DOMINIC OLIVERIO ASKED SO, BASICALLY CRAIG YOU ARE RECOMMENDING THAT THEY GET A VARIANCE SINCE THE BUILDING WAS CONSTRUCTED ALREADY AND THE FEES DOUBLED. YOUR INPUT ON THAT IS YOU JUST DON’T WANT TO GET IT.
SANDY KIRKPATRICK STATED I FEEL THE BUILDING WAS ALREADY THERE AND WE ALREADY HAVE A VARIANCE. I CAN’T SEE WHY WE CAN’T REPLACE WHAT WE HAD BEFORE.
STEVE KIRKPATRICK STATED I SEE NOTHING WRONG WITH BUYING A PERMIT BUT I AM NOT PAYING A VARIANCE.
CHIPPEWA TOWNSHIP TRUSTEES REGULAR

TOWNSHIP HALL 7:00 PM MAY 8, 19

SANDY KIRKPATRICK – COMPLETE RESTORATION OF EXISTING BARN WITHOUT NEED FOR VARIANCE (CONTINUED)
SANDY KIRKPATRICK STATED NONE OF YOU WERE ON THE BOARD WHEN WE WENT TO THE VARIANCE. IT WAS LITTLE UGLY BACK THEN.
CRAIG THORICHT STATED LET ME POINT OUT THEY INDEED GET A VARIANCE TO ERECT A BUILDING. THE BUILDING IN QUESTIONED NOW IS NEXT TO THE BUILDING THAT HAS A VARIANCE. WE ARE TALKING ABOUT TWO SEPARATE BUILDINGS.
STEVE KIRKPATRICK STATED IT IS AN EXISTING BUILDING.
LENNY BROOME STATED CAN WE HAVE AN ADDRESS IF THE TRUSTEES MAY WANT TO DO A DRIVE BY.
SANDY KIRKPATRICK STATED 15069 GALEHOUSE ROAD.
SO, I FIGURED BY THE TIME WE APPLIED FOR A VARIANCE AND IT IS TURNED DOWN. IT DEFEATS THE PURPOSE OF DOING ANYTHING, I JUST DON’T UNDERSTAND WHY WE CAN’T WE FIX WHAT WE HAVE.
LENNY BROOME STATED IF WE ALL FOLLOW THE RULES ALL OF CHIPPEWA TOWNSHIP ACCEPT THE KIRKPATRICK’S, WE WOULD BE HUNG OVER THE COALS FOR THAT. WE EITHER FOLLOW THE RUNS IN CHIPPEWA TOWNSHIP OR WERE NOT. SINCE WE HAVE ZONING, WE DECIDED TO FOLLOW THE RULES. THAT IS WHY I ASKED FOR ADDRESS I THINK THE PRESIDENT WILL PROBABLY SAY WE PUT THIS ON THE TABLE, SO WE CAN RESEARCH IT A LITTLE MORE AND DO SOME DRIVE BYS AND CHEW ON THIS. THAT IS MY RECOMMENDATION.
DOMINIC OLIVERIO STATED OKAY WITH THAT.
SANDY KIRKPATRICK STATED THAT IS TALLER AND SO IT IS MORE NOTICEABLE.
DOMINIC OLIVERIO STATED WE WILL DRIVE BY AND WE WILL BE IN TOUCH WITH YOU.
