DON NOBLE & BECKY JEWELL – RAILS TO TRAILS WERE PRESENT AND REQUESTING A LETTER OF SUPPORT FROM THE TOWNSHIP TO PURCHASE 101 ACRES IN CHIPPEWA TOWNSHIP USING A CLEAN OHIO GRANT. COMMISSIONER BECKY FOSTER STATED THE COMMISSIONERS WROTE A LETTER FOR SUPPORT.
BRAIN BILINOVICH WAS PRESENT AND STATED WE ARE THE ONES; WE WILL BE SELLING THE ACREAGE. WE WERE VERY MUCH PART OF THE OPPOSITION OF THE RAILS TO TRAILS IN THE PAST. IT HAS BEEN A LONG 11-YEAR BATTLE. THIS IS PART OF A NEGOTIATED SETTLEMENT. THIS WHOLE PROCESS AND WE ARE MUCH SUPPORT OF THE GRANT. THIS IS PART OF THE SETTLEMENT OF THE NEGOTIATIONS AND THIS WHY WE ARE HERE.
MICHELLE KOONTZ COMMENTED I AM NEIGHBORS WITH BRIAN AND LAURIE BILINOVICH. THEY ARE VERY GOOD FRIENDS OF OURS AND WE APPRECIATE ALL THEY HAVE DONE IN REGARDS TO OPPOSING THE RAILS TO TRAILS IN THE PAST. WE ARE STILL IN THE LAWSUIT WITH RAILS TO TRAILS. THEIRS IS OVER AND OURS ARE NOT. WE ARE WAITING FOR APPRAISALS TO COME THROUGH AND AT THIS POINT, WE’RE STILL WAITING TO SEE WHAT HAPPENS NEXT WITH GOING FORWARD WITH THE TRAILS.
WE DO SUPPORT THE GRANT. WE ARE JUST LITTLE BIT IN LIMBO HERE BECAUSE WE HAVE NOT RECEIVED ANY OFFICIAL OFFER THAT GOES TOWARDS OUR PROPERTY. AT THIS TIME, THE TRAIL WOULD COME RIGHT IN HER FRONT OF MY HOUSE AND THERE IS NO WAY TO AVOID THAT.

THAT IS WHAT THE LAWSUIT IS ABOUT, SO THAT IS WHERE WE ARE. WE DO SUPPORT THE GRANT. MY HUSBAND AND I BOTH SUPPORT THE GRANT. HOWEVER, WE ARE KIND OF IN A DIFFERENT PLACE WHERE THE BILINOVICH ARE.

TO EVENTUALLY DEVELOP THIS TRAIL FOR RECREATIONAL AND EDUCATIONAL FOR OUR COMMUNITY. THIS PROPERTY WILL ENHANCE THE QUALITY OF LIFE WE HAVE HERE.

A RESOLUTION TO SUPPORT THE RAILS TO TRAILS
WHEREAS, the State of Ohio, through the Ohio Public Works Commission, administers financial assistance for the development of open spaces, through the Clean Ohio Conservation Program; and
WHEREAS, Rails-to-Trails of Wayne County, Ohio, is applying for 2019 grant funding from OPWC District 16 Clean Ohio Conservation Program for the conservation of approximately 100 acres of open space, wetlands and flood plain north of Warwick Road in Chippewa Township, Wayne County; and
WHEREAS, the Chippewa Township Trustees recognizes the opportunity to preserve open spaces and wetlands while providing opportunities for outdoor recreation for persons of all abilities; and
WHEREAS, the Chippewa Township Trustees recognizes this project supports the recommendations of the Chippewa Township Comprehensive Plan to preserve and promote significant natural resource areas.

CRAIG THORICHT STATED I EXPLAINED TO MR. AND MRS. KIRKPATRICK THE FEE STRUCTURE HOW THAT APPLIES. THEIR CONCERNED ABOUT THE VARIANCE. I POINTED OUT HERE THE EXISTING BUILDING THEY HAVE THEY DID APPLY FOR A VARIANCE. THEY WERE GRANTED A VARIANCE FOR VERY VERY LARGE BUILDING. THAT BUILDING BECAUSE OF THE SIZE EXCEEDS BY FAR, WHAT THEY ARE ALLOWED TO HAVE. SO, THIS ADDITIONAL BUILDING THAT IS BEING RECONSTRUCTED AS ON THE SQUARE FOOTAGE SO IT ALSO HAS TO GO THROUGH THE VARIANCE PROCESS. VARIANCE PROCESS THE FEES ARE DOUBLED BECAUSE THE STRUCTURE IS ALREADY STARTED.

I WENT OUT TO THE PROPERTY AND THEY WERE VERY KIND AND VERY OPENED WALKED THROUGH FRAMING OF THE BUILDING. PUBLIC COMMENT: CECIL MIGONI WAS COMPLAINING OF A BROKEN DOWN TRUCK THAT WAS PARKED IN HIS FRONT YARD. HE REPORTED IT TO THE SHERIFFS AND A 48 HOUR NOTICE WAS PLACED ON THE TRUCK. THE TRUCK WAS NOT REMOVED AFTER THE 48 HOURS AND IT WAS VERY DIFFICULT FOR THEM TO COME OUT OF THEIR DRIVEWAY. HE CALLED THE SHERIFF’S OFFICE AND GOT NO REPONSES. OFFICER GAJDA EXPLAINED WHAT GOES ON AND HOW THEY HANDLE BROKEN DOWN VEHICLES. THE TRUCK HAS BEEN REMOVED.
JODI KNICLEY WAS PRESENT AGAIN OVER THE PROPERTY ON VALLEY VIEW. LENNY BROOME STATED THE PLANNING COMMISSION WOULD BE REVIEWING THIS ISSUE.

19-0056-06 ADOPT FEES FOR WASTE DISPOSAL
A RESOLUTION TO ADOPT FEES FOR WASTE DISPOSAL
Motion made by Trustee Stephen Jung; Seconded by Trustee Lenny Broome
WHEREAS, Ohio Revised Code Section 3734.57 permits townships to impose a fee for waste disposal for construction, and/or demolition, solid waste as defined in Ohio Revised Code Section 3734.0l (E); and
WHEREAS, Chippewa Township has located within in it a solid waste disposal facility, to-wit: the Zollinger property located at Zollinger Sand and Gravel, Inc., Construction and Demolition Landfill, 11687 Wadsworth Road, Rittman, Ohio 44270; and
WHEREAS, Section 3734.57(C) of the Ohio Revised Code states that for the purpose of defraying the added costs to a township of maintaining roads and public facilities and of providing emergency and other public services, and compensating a township for reductions in real property tax revenues due to reductions in real property valuations resulting from the location and operation of a solid waste disposal facility within the township, a township in which such a solid waste disposal facility is located may levy a fee of not more than twenty-five cents per ton on the disposal of solid wastes at a solid waste disposal facility located within the boundaries of the township; and
WHEREAS, Chippewa Township desires to levy such a fee, to defray those costs
outlined in the statute.
NOW, THEREFORE, BE IT RESOLVED, that:
1. Chippewa Township levies a fee of twenty-five cents per ton on the disposal of solid waste at the solid waste disposal facility located at 11687 Wadsworth Road, Rittman, Ohio 44270 in Chippewa Township, effective at the earliest time allowed by law;
2. The Board of Trustees authorizes and directs the township fiscal officer to mail a certified copy of this resolution to the Wayne County Board of Commissioners; and to the Board of Trustees of the Joint Solid Waste Management Authority; to the owner and operator of the solid waste disposal facility located in Chippewa Township, Zollinger Sand and

Gravel, Inc., Construction and Demolition Landfill, 11687 Wadsworth Road, Rittman, Ohio 44270 who shall be required to collect the fee set forth in this resolution; and to the Ohio Director of Environmental Protection Agency;As provided in the Ohio Revised Code, the fees levied under this resolution are levied on the basis of tons as the unit of measurement;
3. The board of trustees also authorizes and instructs the fiscal officer, not later than five days after the enactment of this resolution, to notify by certified mail the owner of the solid waste disposal facility that shall be required to collect the fee which is Zollinger Sand and Gravel, Inc., Construction and Demolition Landfill, 11687 Wadsworth Road, Rittman, Ohio 44270;
4. The collection of the fee shall commence on the first day of the second month following the month in which notification is sent to the owner, which is effective August 1, 2019;
5. As stated in Ohio Revised Code Section 3734.57 the fees levied under this resolution shall be collected by the owner and operator of the solid waste disposal facility where the wastes are disposed as trustee for the township of Chippewa. All monies received from the fees levied under this resolution shall be forwarded to the fiscal officer of the township;
6. Monies received by the fiscal officer of the township shall be paid into the general fund of the township. The fiscal officer shall, as appropriate, maintain separate records of the monies received from the fees levied pursuant to this resolution.
