A RESOLUTION TO APPROVE THE DECLARATIONS OF EMERGENCY DECLARED BY THE U.S. GOVERNMENT AND THE STATE OF OHIO, CHIPPEWA TOWNSHIP BOARD OF TRUSTEES HAS DECLARED A STATE OF EMERGENCY IN CHIPPEWA TOWNSHIP, WAYNE COUNTY, OHIO FOR THE DURATION OF THE COVID-19 CORONAVIRUS PANDEMIC.

IN THE EVENT OF EMERGENCY, FIRE STATION 2, 14312 HATFIELD ROAD, RITTMAN WILL BE AN ALTERNATE LOCATION FOR THE TOWNSHIP TO HOLD THEIR PUBLIC MEETINGS.

20-0033-04 TO PARTICIPATE IN ODOT – PURCHASING PROGRAM 2020 

A RESOLUTION AUTHORIZING PARTICIPATION IN THE ODOT ROAD SALT CONTRACTS AWARDED IN 2020

WHEREAS, THE CHIPPEWA TOWNSHIP, WAYNE COUNTY (HEREINAFTER REFERRED TO AS THE “POLITICAL SUBDIVISION”) HEREBY SUBMITS THIS WRITTEN AGREEMENT TO PARTICIPATE IN THE OHIO DEPARTMENT

OF TRANSPORTATION’S (ODOT) ANNUAL ROAD SALT BID IN ACCORDANCE WITH OHIO REVISED CODE 5513.01(B) AND HEREBY AGREES TO ALL OF THE FOLLOWING TERMS AND CONDITION IN ITS PARTICIPATION OF THE ODOT ROAD SALT CONTRACT:

  1. THE POLITICAL SUBDIVISION HEREBY AGREES TO BE BOUND BY ALL TERMS AND CONDITIONS ESTABLISHED BY ODOT IN THE ROAD SALT CONTRACT AND ACKNOWLEDGES THAT UPON OF AWARD OF THE CONTRACT BY THE DIRECTOR OF ODOT IT SHALL BE BOUND BY ALL SUCH TERMS AND CONDITIONS INCLUDED IN THE CONTRACT; AND
  2. THE POLITICAL SUBDIVISION HEREBY ACKNOWLEDGES THAT UPON THE DIRECTOR OF ODOT’S SIGNING OF THE ROAD SALT CONTRACT, IT SHALL EFFECTIVELY FORM A CONTRACT BETWEEN THE AWARDED SALT SUPPLIER AND THE POLITICAL SUBDIVISION; AND
  3. THE POLITICAL SUBDIVISION AGREES TO BE SOLELY RESPONSIBLE FOR RESOLVING ALL CLAIMS OR DISPUTES ARISING OUT OF ITS PARTICIPATION IN THE ODOT ROAD SALT CONTRACT AND AGREES TO HOLD THE DEPARTMENT OF TRANSPORTATION HARMLESS FOR ANY CLAIMS, ACTIONS, EXPENSES OR OTHER DAMAGES ARISING OUT OF THE POLITICAL SUBDIVISION’S PARTICIPATION IN THE ROAD SALT CONTRACT; AND
  4. THE POLITICAL SUBDIVISION ELECTRONIC ORDER FOR SODIUM CHLORIDE (ROAD SALT) WILL BE THE AMOUNT THE POLITICAL SUBDIVISION AGREES TO PURCHASE FROM ITS AWARDED SALT SUPPLIER AT THE DELIVERED BID PRICE PER TON AWARDED BY THE DIRECTOR OF ODOT; AND
  5. THE POLITICAL SUBDIVISION HEREBY AGREES TO PURCHASE A MINIMUM OF 90% OF ITS ELECTRONICALLY SUBMITTED SALT QUANTITIES FROM ITS AWARDED SALT SUPPLIER DURING THE CONTRACT’S EFFECTIVE PERIOD; AND
  6. THE POLITICAL SUBDIVISION HEREBY AGREES TO PLACE ORDERS WITH AND DIRECTLY PAY THE AWARDED SALT SUPPLIER

ON A NET 30 BASIS FOR ALL ROAD SALT IT RECEIVES PURSUANT TO ODOT SALT CONTRACT; AND

  1. THE POLITICAL SUBDIVISION ACKNOWLEDGES THAT SHOULD IT WISH TO RESCIND THIS PARTICIPATION AGREEMENT IT WILL DO SO BY WRITTEN, EMAILED REQUEST BY NO LATER THAN FRIDAY, APRIL 24, 2020 BY 12:00 P.M.  THE WRITTEN, EMAILED REQUEST TO RESCIND THIS PARTICIPATION AGREEMENT MUST BE RECEIVED BY THE ODOT OFFICE OF CONTRACT SALES, PURCHASING SECTION EMAIL: CONTRACTS.PURCHASING@DOT.OHIO.GOV BY THE DEADLINE. THE DEPARTMENT, UPON RECEIPT, WILL RESPOND THAT IT HAS RECEIVED THE REQUEST AND THAT IT HAS EFFECTIVELY REMOVED THE POLITICAL SUBDIVISION’S PARTICIPATION REQUEST.  FURTHERMORE, IT IS THE SOLE RESPONSIBILITY OF THE POLITICAL SUBDIVISION TO ENSURE ODOT HAS RECEIVED THIS PARTICIPATION AGREEMENT AS WELL AS THE RECEIPT OF ANY REQUEST TO RESCIND THIS PARTICIPATION AGREEMENT.  THE DEPARTMENT SHALL NOT BE HELD RESPONSIBLE OR LIABLE FOR FAILURE TO RECEIVE A POLITICAL SUBDIVISION’S PARTICIPATION AGREEMENT AND/OR A POLITICAL SUBDIVISION’S REQUEST TO RESCIND ITS PARTICIPATION AGREEMENT.

THE WAYNE COUNTY COMMISSIONERS HELD A PUBLIC HEARING ON MARCH 18, 2020 FOR  AN APPLICATION FOR AN AGRICULTURAL SECURITY AREA.  APPLICATION HAS BEEN MADE TO PLACE 83.18 ACRES INTO AN AGRICULTURAL SECURITY AREA IN CHIPPEWA TOWNSHIP WITH NO OBJECTIONS.

A RESOLUTION TO APPROVE DISCHARGING SEWAGE DISPOSAL SYSTEM AT 12057 DOYLESTOWN ROAD, RITTMAN. THE PROPERTY OWNER ARE DOUGLAS AND DIANNA BAUMAN.   The septic system consists of an aeration unit discharging into the enclosed road ditch ALONG Morning Star Rd/Shondel rd. THE SYSTEM WILL BE INSPECTED ANNUALLY AND WILL MEET THE CURRENT OHIO ADMINISTRATIVE CODE, CHAPTER 3701-29 AND THE CONDITIONS FOR THEIR OPERATION DISCHARGE PERMIT WITH WAYNE COUNTY HEALTH DEPARTMENT.

COVID- 19 Response Plan LEVEL ONE

Dear Residents:    Kimble Recycling & Disposal, Inc. remains committed to the safe & sanitary condition of your community and the safety and health of our employees.

Because of the COVID-19-related governmental declarations of emergency and regulations, and due to the stay at home order and potential COVID-19 related labor shortages, we must adjust routes & schedules to collect the large increase in residential waste volumes. We are taking precautionary steps and asking our customers to make the necessary changes, to allow us to focus on the essential business of solid waste collections. We are asking for the cooperation of our customers to minimize the disruptions to essential services.   Effective, Monday April 13, 2020 to protect our workers and avoid service disruptions, we are asking for your help by implementing the following changes.

Solid Waste: Please fit all materials into the Kimble provided waste cart leaving no materials on the ground to be loaded by hand. Collection will occur as usual. For customers whose service does not include a waste cart; please limit your trash to a maximum of three 30-gallon sealed bags.

Recycling (where applicable): Please fit all recycle items in the Kimble provided recycle cart, leaving no materials on the ground to be collected by hand. Include only clean paper, cardboard, metal cans and #1 and #2 plastic containers and jugs. (See website at www.kimblecompanies.com for acceptable recyclable items.) Collection will occur as usual.

Bulk items: Please temporarily hold bulk items that require hand loading, such as sofas, mattresses, appliances, toilets and other bulky items. Items that can be broken or disassembled and placed in the Kimble waste cart, will be collected.   Yard Waste: As a non-essential waste stream, we ask that you suspend placing yard waste at the curb in excess of what fits in the Kimble waste cart or as part of your three 30-gallon solid waste sealed bags, for those customers without waste carts. Please consider options such as, composting, taking the materials to a community collection point, or holding until a later time.

We are continually monitoring the COVID-19 situation and developing plans that can be implemented to continue to respond to this public health emergency. These measures will be implemented as needed to protect the health and safety of our employees, customers and communities we serve.
