20-0038-04 APPROVE AGRICULTURAL SECURITY AREA                                                                                                                                                                                                                                                        A RESOLUTION TO APPROVE THE APPLICATION REQUESTING THE ESTABLISHMENT OF AN AGRICULTURAL SECURITY AREA

IN CHIPPEWA TOWNSHIP, WAYNE COUNTY, OHIO

WHEREAS, Chapter 931 of the Ohio Revised Code permits one or more landowners to submit an application to the appropriate boards of county commissioners and township trustees requesting that at least 500 acres of contiguous farmland be enrolled in an Agricultural Security Area for a period of 10 years; and

WHEREAS, Agricultural Security Areas provide certain benefits to farmers, including protection from non-farm development and critical mass of land; and

WHEREAS, Agricultural Security Areas help keep farming economically viable; and

WHEREAS, Wayne County’s economy is greatly dependent upon agriculture and the protection of farmland; and

WHEREAS, Wayne County has a total of 2,034 farms, located on approximately 1,043,646 acres of land, that are responsible for annual cash receipts of approximately $327,890,000.00 (data provided by the Ohio Department of Agriculture’s 2018- 2019 Annual Report; 2017 Census); and

WHEREAS, Agricultural Security Areas are a partnership between the participating landowner(s) and local elected officials consisting of county commissioners and township trustees; and

WHEREAS, pursuant to Section 931.02 of the Ohio Revised Code, three landowners, CAT LAND CO LTD (523.652 acres); John W & Lois C Douglass (5.5 acres); SATYZA Farms Inc. (83.18 acres), have submitted an application requesting that their properties be enrolled in an Agricultural Security Area consisting of approximately 612.332 acres of contiguous farmland located in Chippewa and Baughman Townships (hereinafter referred to as the “Application”); and

WHEREAS, all notices required in Section 931.03 of the Ohio Revised Code were provided; and

WHEREAS, pursuant to Section 931.03(A) of the Ohio Revised Code, on March 18, 2020, the Board of County Commissioners of Wayne County, Ohio, the Board of Township Trustees of Chippewa Township, Wayne County, Ohio, and the Board of Township Trustees of Baughman Township, Wayne County, Ohio held a joint public meeting on the Application; and

20-0038-04 APPROVE AGRICULTURAL SECURITY AREA (CONTINUED)

WHEREAS, pursuant to Section 931.03(A)(3) of the Ohio Revised Code, not later than forty-five (45) days after a board of township trustees hears the application a board of township trustees shall adopt a resolution either approving or rejecting the Application.

NOW, THEREFORE, BE IT RESOLVED by the Board of Township Trustees of Chippewa Township, Wayne County, Ohio (“Board”), that:

Section 1.    The Application meets the requirements specified in Section 931.02 of the Ohio Revised Code.

Section 2.    The Board approves the establishment of the requested Agricultural Security Area as submitted in the Application.

Section 3.    The Board commits not to initiate, approve, or finance any development for residential, commercial, or industrial purposes, including construction of new roads and water and sewer lines, within the Agricultural Security Area referenced above in Section 1 for a period of ten years. The applicants have agreed not to initiate, approve, or finance any new development for non-agricultural purposes within the Agricultural Security Area referenced above in Section 1 during the aforementioned ten-year period.

Section 4.    All owners of land within the Agricultural Security Area referenced above in Section 1 are hereby required to use best management practices.

Section 5.    The Agricultural Security Area referenced above in Section 1 will become effective on the date all required resolutions are approved by all required boards of county commissioners and township trustees, and it may continue in existence for a period of ten years, unless it is terminated pursuant to law.

BE IT FURTHER RESOLVED, that a copy of this resolution shall be sent to the Director of Agriculture, the Director of Transportation, the superintendent of each school district within that area, the county engineer, and the county auditor.

IT IS FURTHER RESOLVED, that all formal actions of this Board concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Board of Township Trustees and that all deliberations of such Board were in meetings open to the public, in compliance with Ohio law, including §121.22.

Mr. JUNG made the motion to adopt the Resolution and Mr. BROOME seconded that said motion.

20-0045-04 ADOPT DEFINITION OF AN EMERGENCY RESPONDER                                                                                                                                                                                                                                       A RESOLUTION TO ADOPT DEFINITION OF AN EMERGENCY RESPONDER AS DEFINED BY THE U.S. DEPARTMENT OF LABOR                                                                                                                WHEREAS, COVID-19 is a pandemic affecting the entire human population of the world; and                                                                                                                                                                                 WHEREAS, the Ohio Department of Health Director has imposed stay-at-home orders, prohibitions of mass gatherings, and methods aimed at slowing the COVID-19 virus; and                                                          WHEREAS, the United States Congress enacted on March 18, 2020 the COVID-19 Response Act; and                                                                                                                                                                          WHEREAS, that act known generally as The Families First Corornavirus Response Act suggested that emergency responders are not covered by that Act, but did not define emergency responders.

NOW, THEREFORE, BE IT RESOLVED, that:

  1. The Board of Trustees of Chippewa Township shall adopt as the definition of an emergency responder the guidance provided by U.S. Department of Labor as follows:

“For the purposes of Employees who may be excluded from Paid Sick Leave or Expanded Family and Medical Leave by their Employer under the FFCRA, and emergency responder is anyone necessary for the provision of transport, care, healthcare, comfort and nutrition of such patients, or others needed for the response to COVID-19.  This includes but is not limited to military or national guard, law enforcement officers, correctional institution personnel, fire fighters, emergency medical services personnel, physicians,

20-0045-04 ADOPT DEFINITION OF AN EMERGENCY RESPONDER (CONTINUED)                                                                                                                                                                                                        nurses, public health personnel, emergency medical technicians, paramedics, emergency management personnel, 911 operators, child welfare workers and service providers, public works personnel, and persons with skills or training in operating specialized equipment or other skills needed to provide aid in a declared emergency, as well as individuals who work for such facilities employing these individuals and whose work is necessary to maintain the operation of the facility.  This also includes any individual whom the highest official of a State or territory, including the District of Columbia, determines is an emergency responder necessary for that State’s or territory’s of District of Columbia’s response to COVID-19″.

2. Due to the nature of this emergency and the need to provide fire, ambulance, paramedic, police and other emergency responder services to the citizens of Chippewa Township, and upon the advice of the township attorney, the Board of  Trustees excludes emergency responders from the provision of the Families First Coronavirus Response Act.

3.The Chippewa Township Board of Trustees urges the Wayne County Board of  Commissioners to either cooperate with Summit County to use the same hotel  facilities or create its own program similar to that set up by Summit   County which provides hotel rooms for those emergency responders who  are required to quarantine for 14 days due to the COVID-19 emergency.    The purpose of this is to allow quarantine by those individuals in an area      separate and apart from their families so as reduce the risk of transmission of the coronavirus to their family members.

4. In order to prevent the spread of the coronavirus, the Chippewa Township Board of Trustees directs that all employees have their temperature taken   prior to beginning their work shift and shall record their temperature and the   time taken  on a form as provided by the Township.

  1. Further, the Chippewa Township Board of Trustees will continue to monitor this emergency in order to protect the health, safety and welfare of  Chippewa Township’s citizens and their public employees of Chippewa Township.

EMPLOYEE HANDBOOK COVID-19 EMERGENCY                                                                                                                                                                                          A RESOLUTION TO ADOPT  ADDENDUMS TO TOWNSHIP EMPLOYEE POLICY HANDBOOK COVID-19 EMERGENCY                                                                                                                                    WHEREAS, pursuant to the State of Ohio Department of Health and declaration of National  Emergency declared by the President of the United States due to the COVID-19  Emergency, the Board of Trustees of Chippewa Township determines that it is in the best interest of the public safety, health, and welfare of Chippewa Township, its employees and citizens to implement certain policies to the Chippewa Township Employee Policy Handbook.

NOW, THEREFORE, BE IT RESOLVED, that:
